1. Introduction

Welcome to TTS.Mom. These Terms of Service ("Terms") govern your use of the TTS.Mom website, applications, APIs, and services (collectively, the "Services") operated by TTS.Mom ("we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

In these Terms, the following terms shall have the meanings set forth below:

• "Content" means any text, images, graphics, audio, video, software, data compilations, and other materials that you may encounter on our Services or that you may contribute to our Services.
• "User", "you", and "your" refers to the individual, company, or organization that has visited or is using the Services.
• "TTS" means text-to-speech technology that converts written text into spoken voice output.
• "Streaming Platform" refers to any third-party service such as Kick, Twitch, YouTube, or other platforms where you may use our Services.

3. Account Registration and Eligibility

To access certain features of our Services, you must register for an Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.

To use our Services, you must be at least 13 years of age. If you are under 18, you must have the permission of a parent or guardian to use our Services.

We reserve the right to terminate or suspend your Account at any time for any reason, including but not limited to, violation of these Terms.

4. Subscription and Payment Terms

Some of our Services are available on a subscription basis. By subscribing to our Services, you agree to pay the applicable fees as they become due.

Payments are processed through Stripe, a third-party payment processor. Your use of Stripe's services is subject to Stripe's terms of service and privacy policy. We do not store your full credit card information on our servers.

Subscription fees are billed in advance on a recurring basis, depending on the subscription plan you select. You authorize us to charge your payment method for the subscription fees until your subscription is terminated.

You may cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of the current billing period. We do not provide refunds for the unused portion of your subscription period.

We reserve the right to change our subscription fees upon reasonable notice. If you do not agree to the fee changes, you have the right to reject the changes by canceling your subscription prior to the change going into effect.

5. Usage of Service

TTS.Mom provides text-to-speech services primarily intended for use with streaming platforms. By using our Services, you agree to the following:

5.1. Acceptable Use

You agree not to use the Services in any way that:

• Violates any applicable law, regulation, or these Terms
• Infringes upon the rights of others
• Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Jeopardizes the security of your Account or the Services
• Attempts to decipher, decompile, disassemble, or reverse engineer any of the software comprising or making up the Services
• Interferes with or disrupts the integrity or performance of the Services
• Attempts to gain unauthorized access to the Services or related systems or networks

5.2. Content Guidelines

You are solely responsible for the Content that you create, upload, post, or otherwise make available through the Services. You agree that the Content will not:

• Contain material that is illegal, abusive, harassing, threatening, or otherwise inappropriate
• Promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
• Contain excessive profanity or explicit sexual content
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
• Contain any material that infringes or violates the intellectual property rights of others
• Contain any material that violates the terms of service of any streaming platform where you use our Services

We reserve the right to remove any Content that, in our sole judgment, violates these guidelines or is otherwise objectionable.

5.3. API Usage and Rate Limits

If you use our API, you agree to abide by any rate limits, authentication requirements, and other API usage guidelines that we may establish from time to time. We reserve the right to throttle or block API access that, in our sole discretion, negatively impacts the performance of our Services for other users.

5.4. Third-Party Platform Integration

Our Services may integrate with third-party platforms such as Kick, Twitch, YouTube, or other streaming services. You are responsible for complying with the terms of service of those platforms. We are not responsible for any issues arising from the use of our Services in conjunction with third-party platforms.

6. Intellectual Property Rights

6.1. Our Intellectual Property

The Services and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of TTS.Mom and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.2. Your Content

By submitting Content to our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such Content in connection with providing our Services. This license continues even if you stop using our Services, solely to the extent necessary for us to provide the Services to other users.

You represent and warrant that: (i) you own the Content you submit or have the right to use it and grant us the rights as provided in these Terms, and (ii) the submission of your Content to or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

6.3. Voice Models and Generated Audio

The voice models provided through our Services are licensed to us by third-party providers or developed internally. You may not reverse engineer, extract, or otherwise attempt to reproduce these voice models. The rights to generated audio content are subject to the terms of the specific voice model used and our Services' features at the time of generation.

7. User-Generated Content

Our Services may allow you to create, upload, post, send, receive, and store content, including but not limited to text, graphics, videos, images, or other materials ("User Content"). You retain your rights to any User Content you submit, post, or display on or through the Services.

By submitting User Content to the Services, you grant TTS.Mom a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such User Content for the purpose of operating, developing, providing, and improving the Services.

You are solely responsible for your User Content and the consequences of posting or publishing it. We have the right, but not the obligation, to monitor and review User Content on the Services.

8. Third-Party Services

Our Services may contain links to third-party websites or services that are not owned or controlled by TTS.Mom. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that TTS.Mom shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TTS.MOM, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.

WITHOUT LIMITING THE FOREGOING, UNDER NO CIRCUMSTANCES WILL TTS.MOM BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICES OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TTS.MOM ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY: (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICES; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY; AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TTS.MOM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TTS.MOM MAKES NO WARRANTY THAT: (I) THE SERVICES WILL MEET YOUR REQUIREMENTS; (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

11. Indemnification

You agree to defend, indemnify, and hold harmless TTS.Mom, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.

12. Term and Termination

These Terms shall remain in full force and effect while you use the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your Account, you may simply discontinue using the Services or contact us to request Account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law
